Frequently asked questions.

  • Attorneys who represent employees in workers’ compensation are paid with a contingency fee. This means you do not pay anything out of pocket and do not owe anything to your attorney if they do not win money for you. In California, workers’ compensation attorneys usually receive 15% of the amount of money that they win for their client.

  • Workers’ compensation provides free medical treatment and monetary benefits to injured workers. Injured workers are entitled to disability benefits while they are off work. We routinely win monetary awards for our clients’ injuries and awards of free lifetime medical treatment through workers’ compensation. If your injury prevents you from returning to your job, you should receive funds for job retraining and education.

  • It is unlawful to harass or discriminate against an employee who has filed a workers’ compensation claim. If an employer breaks the law, they are liable for lost wages and other damages in a separate claim under employment law. We focus on workers’ compensation and do not practice employment law. But we do help some of our clients retain legal representation for claims under employment law.

There are also time limits for reporting injuries so you should not delay if you want to pursue a claim and have not already opened one with your employer’s workers’ compensation insurer.

  • Tough one! A lot of depends how long it takes to recover from the injury. Some claims resolve in a few months, some take many years. This is an area where our personalized approach helps minimize delays as opposed many of our competitors.
